Intellectual Property (IP) Arbitration
The Center for International Mediators and Arbitrators (CIMA) offers specialized training and institutional case management in Intellectual Property (IP) Arbitration, providing a confidential, efficient, and expert-driven forum for resolving disputes involving copyrights, trademarks, patents, trade secrets, licensing agreements, and other IP assets.
CIMA’s IP Arbitration training is tailored for IP lawyers, in-house counsel, inventors, brand managers, regulators, and creatives operating within innovation-driven industries. The curriculum covers the intersection of IP law and arbitration practice, including the enforceability of IP-related arbitration clauses, arbitrability of IP rights across jurisdictions, and the application of rules under institutions such as the WIPO Arbitration and Mediation Center, ICC, and UNCITRAL.
Participants gain practical knowledge in managing cross-border licensing disputes, FRAND terms in standard-essential patents, digital copyright issues, IP infringement in international commerce, and disputes arising under technology transfer and R&D agreements. The program also explores current issues like AI-generated works, digital content protection, and blockchain-based IP registration.
CIMA’s IP Dispute Management Unit administers arbitration proceedings with a focus on speed, confidentiality, and technical accuracy. Arbitrators with both legal and technical expertise are appointed to ensure credible and enforceable outcomes. The institution supports online filings, virtual hearings, and integration with national IP registries and enforcement agencies where needed.
In a global economy where intellectual capital is central to competitive advantage, CIMA ensures that IP stakeholders—whether creators, businesses, or investors—have access to trusted, neutral, and enforceable mechanisms for resolving disputes across jurisdictions and sectors.
